NDC Workforce Management System

LEGALLY BINDING AGREEMENT

By accessing, logging into, or using the NDC Workforce system in any capacity, you expressly agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must immediately cease all use of this system. Violation of any terms may result in immediate termination of access, disciplinary action, and/or legal action.

1.Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User") and NDC Workforce ("System"). By using this system, you represent and warrant that you are authorized to access and use this system as an employee, supervisor, manager, or administrator of the organization. Unauthorized access is a criminal offense under the Criminal Code of Canada and applicable provincial laws.

2.Authorized Use

The NDC Workforce system is provided exclusively for:

  • Reporting and managing employee absences and attendance
  • Processing overtime (OT) and voluntary time-off (VTO) requests
  • Receiving and responding to official workplace communications
  • Accessing employment-related information within your authorized scope

Any use beyond these authorized purposes is strictly prohibited.

3.User Responsibilities

As a user of this system, you agree to:

  • Maintain the confidentiality of your login credentials
  • Never share your password, PIN, or access tokens with anyone
  • Report any security incidents or unauthorized access immediately
  • Provide accurate and truthful information in all submissions
  • Log out of the system when not in use
  • Use only authorized devices to access the system
  • Comply with all company policies and procedures

4.Prohibited Conduct

THE FOLLOWING ACTIONS ARE STRICTLY PROHIBITED AND WILL RESULT IN IMMEDIATE CONSEQUENCES:

  • Unauthorized Access: Accessing accounts, records, or systems without authorization
  • Data Theft: Copying, downloading, or exporting data for unauthorized purposes
  • Falsification: Submitting false absence reports, time records, or other information
  • Credential Sharing: Sharing login credentials or allowing others to use your account
  • System Abuse: Attempting to hack, probe, or disrupt system operations
  • Privacy Violations: Accessing or disclosing personal information without authorization
  • Impersonation: Using another person's credentials or identity
  • Circumvention: Bypassing or attempting to bypass security controls

5.Monitoring and Audit

ALL SYSTEM ACTIVITY IS MONITORED AND LOGGED

By using this system, you acknowledge and consent to comprehensive monitoring of all activities, including but not limited to: login attempts, data access, record modifications, downloads, and SMS communications. Audit logs are retained and may be reviewed at any time without notice. Evidence of policy violations will be reported to management and may be used in disciplinary proceedings or legal action.

6.Intellectual Property

The NDC Workforce system, including all software, code, design, content, and documentation, is the exclusive property of the organization. You are granted a limited, non-transferable license to use the system for authorized purposes only. You may not copy, modify, distribute, reverse engineer, or create derivative works based on any system component without express written permission.

7.Disclaimer of Warranties

The system is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. While we strive to maintain system availability and accuracy, we do not guarantee uninterrupted access, error-free operation, or the accuracy of all data. Users are responsible for verifying critical information through official channels.

8.Limitation of Liability

To the maximum extent permitted by law, NDC Workforce and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the system. This includes, but is not limited to, damages for loss of data, business interruption, or any other commercial damages or losses.

9.Enforcement and Consequences

Violations of these Terms may result in:

  • Immediate suspension or termination of system access
  • Formal disciplinary action up to and including termination of employment
  • Civil legal action for damages
  • Criminal prosecution under applicable laws
  • Reporting to law enforcement authorities

10.Modifications to Terms

We reserve the right to modify these Terms at any time without prior notice. Changes become effective immediately upon posting. Your continued use of the system after any modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

11.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

12.Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.
